This Privacy Policy describes how OWL FOOD LLC ("OWL Food," "we," "us," or "our"), collects, uses, shares, and protects personal information when you visit our website (the "Site"), purchase or subscribe to our products, subscribe to our communications, or otherwise interact with us (collectively, the “Services”).

By using the Site or providing us with personal information, you acknowledge the practices described in this Policy. If you do not agree with this Policy, please do not use the Site.

This Policy applies to U.S. consumers only.

1. Information We Collect

Information You Provide

We may collect personal information you provide directly when you:

  • Create a customer account

  • Place an order or enroll in a subscription

  • Sign up for our email list

  • Submit a product review or other user-generated content

  • Contact customer service

  • Participate in a promotion, marketing, survey, or sweepstakes

  • Mailing and billing addresses

  • Payment information (processed securely via payment processors)

  • Order history and subscription preferences

When you visit the Site, we and our service providers may automatically collect:

Information From Third Parties

At this time, we do not collect or process Sensitive Personal Information (SPI) as defined under applicable privacy laws, such as biometric data, precise geolocation, or data revealing racial or ethnic origin, political opinions, or religious beliefs.  If we begin collecting SPI in the future, we will update this Policy and ensure compliance with applicable laws, such as obtaining your explicit consent where required.  You will also have the right to limit the use or disclosure of your SPI, as outlined under laws like CPRA.

2. How We Use Personal Information

We use personal information to:

  • Process and fulfill orders, including recurring subscription orders

  • Manage customer accounts

  • Communicate about orders, shipments, and customer service

  • Send marketing emails to subscribers

  • Send transactional and promotional communication

  • Operate, improve, and personalize our Services and the Site

  • Conduct analytics and research

  • Measure advertising and marketing performance

  • Detect, investigate, and prevent fraud, security incidents, and illegal activity

  • Comply with legal obligations, including tax and recordkeeping requirements

  • Enforce our terms and protect our rights

If we need to process your data for a purpose not outlined in this Policy, we will notify you and, where required by law, obtain consent before proceeding.

 

3. Cookies, Tracking Technologies, and Online Advertising

We use cookies, web beacons, pixels, and similar technologies to operate the Site, remember preferences, analyze performance, and support advertising.

Categories of cookies we use or may use:

  • Strictly necessary — required for the Site to function (shopping cart, login, security).

  • Performance and analytics

  • Advertising and targeting 

You can manage cookies through your browser settings, and through our cookie preference tools where available.  Blocking some cookies may affect Site functionality.

We respond to Global Privacy Control (GPC) signals as a valid opt-out of "sale" and "sharing" of personal information for residents of states that recognize GPC. 

Targeted advertising practices

From time to time we may work with third party advertising and analytics partners to provide you with relevant ads based on your browsing behavior on our Site.

4. How We Share Personal Information

We share personal information in the following circumstances:

Service providers. We share information with vendors that perform services for us, including payment processing, order fulfillment, shipping, email marketing, web hosting, analytics, customer support, customer reviews, marketing and advertising services, and IT and security services. These providers are contractually limited to using personal information for the services they perform on our behalf.

Advertising and analytics partners. For purposes such as targeted advertising, measurement and attribution, and website analytics.

Legal compliance and safety. We may disclose information when we believe in good faith that disclosure is required to comply with a subpoena, court order, or other legal obligation; to protect the rights, property, or safety of OWL FOOD, our customers, or others; or to investigate fraud or violations of our terms.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction.

With your direction or consent. We share information when you direct us to or otherwise consent.

5. Selling and sharing of personal information

We do not sell personal information for money. 

However, under certain U.S. state privacy laws, disclosure of personal information for cross-context behavioral advertising may be considered a "sale" or "sharing".  This may include:

·       use of third-party advertising cookies

·       disclosure of identifiers and internet activity data to advertising networks.

6.  Do not sell or share my Personal Information

OWL FOOD does not sell your Personal Information for monetary consideration.

You have the right to opt out of the sale or sharing of your Personal information for targeted advertising.  To exercise this right you may:

·       Adjust your cookie preferences using our cookie management tool and/or through your browser.

·       Submit a privacy request to OWL FOOD using the contact information outline in section 14.

7. Your Privacy Rights

Depending on your state of residence, you may have the right to:

·       Access Personal information we hold about you

·       Correct inaccurate personal information

·       Delete Personal Information

·       Obtain a portable copy of your data

·       Opt out of targeted advertising

·       Opt out of sale or sharing of Personal Information

·       Limit use of sensitive Personal Information (where applicable)

·       Not be discriminated against for exercising your rights

California Residents (CCPA / CPRA)

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, disclose, sell, or share

  • Access the specific pieces of personal information we hold about you

  • Correct inaccurate personal information

  • Delete personal information, subject to legal exceptions

  • Opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising

  • Limit the use and disclosure of sensitive personal information (SPI)

  • Non-discrimination for exercising any of these rights

Shine the Light (Cal. Civ. Code §1798.83). California residents may request information about the categories of Personal Information (if any) we have shared with third parties for their direct marketing purposes during the previous calendar year, as well as the names and addresses of those third parties.

We will verify your identity before processing requests. You may use an authorized agent; we will require written authorization and verification.

Other US State Residents

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas, Oregon, Montana, Delaware, New Hampshire, New Jersey, Indiana, Iowa, Tennessee, Minnesota, Maryland, and other states with comprehensive consumer privacy laws may have similar rights, including the right to access, correct, delete, obtain a portable copy of personal information, and opt out of targeted advertising, sale, or certain profiling activities. We will honor state specific privacy rights as required by applicable law.  To exercise any rights unique to your state, please contact us using the information provided in section 14.

Do Not Sell or Share / Limit Use of Sensitive Personal Information. Email us at hoot@owlenegrybar.com with "Do Not Sell or Share" or "Limit Use of Sensitive PI" in the subject line. We also recognize the Global Privacy Control browser signal as a valid opt-out.

Please note: We do not currently share Personal Information with third parties for their direct marketing purposes.  If this changes in the future, we will update this section accordingly.

8. Subscription Auto-Renewal

If you enroll in a subscription product, you authorize us to automatically charge your payment method at the frequency you selected until you cancel. We will send a reminder before each charge where required by law. You may cancel a subscription at any time by signing into your account or by emailing hoot@owlenergybar.com. Cancellation takes effect for future shipments; charges already processed for shipped orders are governed by our refund policy.

9. Data Retention

We retain Personal Information only as long as reasonably necessary for the purposes described in this Policy, unless a longer retention period is required or permitted by law.

Retention decisions are based on:

  • The nature of the data

  • The purpose for which it was collected

  • Ongoing customer relationships

  • Legal, accounting, or compliance obligations

  • Dispute resolution and fraud prevention needs

Order data is generally retained for up to 7 years to comply with tax, accounting and consumer protection laws. Marketing data is retained until you opt out or request deletion.  We may retain information longer where required by law or to defend legal claims.

10. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information.  These include encryption to protect data in transit, access controls to limit access to Personal Information, and regular evaluations to identify potential vulnerabilities. Payment card data is processed by PCI-DSS compliant providers and is not stored on our servers. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you as required by law.

11. Links to Other Sites

The Site may contain links to third-party websites, including distributor and retailer pages. We are not responsible for the privacy practices or content of those sites. Review their privacy policies before providing personal information.

12. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it.

13. Changes to This Policy

We may update this Policy from time to time.
When we make material changes, we will:

  • Post the updated Policy on our website

  • Update the “Last Updated” date

Your continued use of the Services constitutes acceptance of the updated Policy.
